AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and NeteGreek LLC, doing business as Budgets (“Budgets”, “we”, “us”, or “our”), concerning your access to and use of https://www.budgets.money, https://my.budgets.money, any related websites, and any related mobile applications, features, content, or services that link to these Terms (collectively, the “Service”).

By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you are prohibited from using the Service and must discontinue use immediately.

We may update these Terms from time to time. We will indicate changes by updating the “Last updated” date above. If we make material changes, we may provide additional notice through the Service, email, or another reasonable method. Your continued use of the Service after updated Terms are posted means you accept the updated Terms.

The Service is intended for users located in the United States. If you access the Service from outside the United States, you are responsible for compliance with local laws.

ELIGIBILITY

The Service is intended for users who are at least 18 years old. Persons under 18 years of age are not permitted to register for or use the Service.

By using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to agree to these Terms, and will use the Service in compliance with applicable laws.

ACCOUNTS AND REGISTRATION

You may be required to create an account to use certain parts of the Service. You agree to provide accurate, current, and complete account information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly at hello@budgets.money if you believe your account has been compromised.

We may suspend or terminate your account if we believe information you provide is inaccurate, incomplete, misleading, or violates these Terms.

THE SERVICE

Budgets helps users organize, understand, and plan household finances. Features may include budget categories, account connections, transaction information, household sharing, reports, goal tracking, and related educational content.

We may modify, suspend, or discontinue all or part of the Service at any time. We are not liable for any modification, suspension, or discontinuance of the Service.

NOT FINANCIAL ADVICE

Budgets provides budgeting, organization, educational, and informational tools. Budgets does not provide financial, investment, tax, legal, accounting, credit, or other professional advice.

You are solely responsible for financial decisions you make. You should consult a qualified professional before making decisions based on your personal financial, tax, legal, investment, or credit situation.

BANK CONNECTIONS AND THIRD-PARTY SERVICES

The Service may allow you to connect financial accounts through third-party providers such as Plaid. We do not ask for or store your bank login credentials. Account, balance, and transaction information provided through third-party connections is used to provide and improve the Service.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, including their availability, accuracy, acts, omissions, or privacy practices.

FEES, SUBSCRIPTIONS, AND PAYMENT

Some parts of the Service may be offered for free, through a beta program, as a free trial, or as a paid subscription. If paid features are offered, the price, billing period, trial terms, and renewal terms will be disclosed when you sign up or subscribe.

You agree to provide current, complete, and accurate billing information for purchases made through the Service. Payments may be processed by third-party payment processors such as Stripe. We do not store full payment card numbers.

If you subscribe to a recurring paid plan, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel. We may change prices, but we will provide notice when required by law or by the applicable platform rules.

FREE TRIALS AND BETA ACCESS

We may offer free trials, beta access, or early-access programs. Trial or beta terms may differ from paid subscription terms and may change as the product evolves.

If a free trial converts to a paid plan, we will disclose the conversion terms before charging you.

CANCELLATION, ACCOUNT DELETION, AND EXPORTS

You may cancel a paid subscription through the account settings, the app store where you purchased the subscription, or by contacting us at hello@budgets.money. Cancellation takes effect at the end of the current paid term unless otherwise stated at the time of purchase or required by applicable law.

You may request account deletion by using available account settings or by contacting us at hello@budgets.money. After receiving a deletion request, we will delete or de-identify personal information associated with your account unless we need to retain certain information for legal, security, fraud prevention, accounting, dispute resolution, or legitimate business purposes.

Where supported by the Service or required by law, you may request an export of your account information. Some historical, derived, backup, or system information may not be available in an export.

MOBILE APPLICATIONS

If you access the Service through a mobile application, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the mobile application on devices you own or control, solely for your personal use and in accordance with these Terms and the applicable app store rules.

You may not reverse engineer, decompile, disassemble, modify, copy, distribute, sell, lease, sublicense, or create derivative works from the mobile application except to the extent applicable law prohibits these restrictions.

APP STORE TERMS

If you download a mobile application through the Apple App Store, Google Play, or another app marketplace, the marketplace’s terms may also apply. The app marketplace is not responsible for providing maintenance or support for the Service unless required by its own rules.

If your subscription is purchased through an app marketplace, cancellation and billing may be managed through that marketplace account.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Service and all source code, databases, functionality, software, designs, text, images, graphics, logos, trademarks, service marks, and other content in the Service (collectively, the “Content”) are owned or controlled by us or licensed to us.

Subject to your compliance with these Terms, we grant you a limited license to access and use the Service for your personal, non-commercial use. We reserve all rights not expressly granted to you.

USER CONTENT AND FEEDBACK

You may submit information, content, questions, comments, suggestions, or feedback through the Service (“Submissions”). You are responsible for your Submissions and must have the rights needed to submit them.

Feedback, suggestions, ideas, and similar submissions may be used by us without restriction or compensation to you.

PROHIBITED ACTIVITIES

You agree not to:

  • use the Service for any illegal or unauthorized purpose;
  • access or use the Service through automated or non-human means except as permitted by us;
  • interfere with, disrupt, or create an undue burden on the Service;
  • attempt to bypass security, rate limits, or access controls;
  • upload or transmit viruses, malicious code, or harmful material;
  • impersonate another person or misrepresent your affiliation with any person or entity;
  • collect user information without permission;
  • use the Service to compete with us or to build a substitute product;
  • harass, threaten, abuse, or harm another person; or
  • use the Service in a manner inconsistent with applicable laws or these Terms.

PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy, which is incorporated into these Terms by reference.

TERM AND TERMINATION

These Terms remain in effect while you use the Service. We may suspend or terminate your access to the Service if we believe you have violated these Terms, created risk or possible legal exposure for us, or used the Service in a way that may harm us, other users, or the Service.

If your account is terminated or suspended, you may not create another account without our permission.

GOVERNING LAW

These Terms and your use of the Service are governed by the laws of the State of Texas, without regard to conflict of law principles.

DISPUTE RESOLUTION

To help resolve disputes efficiently, the parties agree to first attempt to resolve any dispute, controversy, or claim related to these Terms informally for at least thirty (30) days before initiating arbitration or court proceedings, except for claims that require immediate injunctive or equitable relief.

If the parties cannot resolve a dispute informally, the dispute will be finally and exclusively resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association and, where appropriate, the AAA Consumer Arbitration Rules. Arbitration may be conducted in person, by phone, online, or through written submissions.

Unless otherwise required by applicable law or AAA rules, arbitration will take place in Travis County, Texas. If a dispute proceeds in court rather than arbitration, it must be commenced in the state or federal courts located in Travis County, Texas, and each party consents to the jurisdiction and venue of those courts.

No dispute related to the Service may be commenced more than one (1) year after the cause of action arose, except where applicable law requires a longer period.

Arbitration will be conducted only on an individual basis. To the fullest extent permitted by law, class arbitrations, class actions, private attorney general actions, and representative proceedings are not permitted.

CORRECTIONS

The Service may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct errors and update information at any time.

DISCLAIMER

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, accurate, complete, or error-free, or that financial account information provided by third parties will always be current or accurate.

LIMITATIONS OF LIABILITY

To the fullest extent permitted by law, we and our directors, employees, contractors, and agents will not be liable for indirect, consequential, exemplary, incidental, special, punitive, or similar damages, including lost profits, lost revenue, or loss of data, arising from or related to your use of the Service.

To the fullest extent permitted by law, our total liability to you for any claim related to the Service will not exceed the amount you paid to us during the six (6) months before the event giving rise to the claim.

Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you.

INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of applicable law, or your violation of another person’s rights.

ELECTRONIC COMMUNICATIONS

By using the Service, sending us email, or completing online forms, you consent to receive electronic communications from us. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

CALIFORNIA USERS AND RESIDENTS

If a complaint is not resolved to your satisfaction, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

MISCELLANEOUS

These Terms and any policies posted by us on the Service constitute the entire agreement between you and us regarding the Service. Our failure to enforce any provision is not a waiver. If any provision is found unenforceable, the remaining provisions remain in effect. We may assign our rights and obligations under these Terms.
